| Sir John Sparrow David Thompson [PC 1894] | |||||
| Sir John Thompson was the fourth Prime Minister of Canada, serving in this office between | |||||
| December 1892 and his death. On 12 December 1894, while Sir John was in England, he | |||||
| was invited to Windsor Castle to attend a meeting of the Privy Council, at which meeting | |||||
| he was to be sworn of the Council. Within an hour of being so sworn, Sir John died as a | |||||
| result of a heart attack. The following account of his death appeared in the 'North | |||||
| Eastern Daily Gazette' published in Middlesbrough on 13 December 1894:- | |||||
| 'The usual quiet routine of Court life at Windsor was rudely interrupted yesterday by a | |||||
| most distressing event. The Queen had summoned a Privy Council meeting to be held at | |||||
| the Castle at noon yesterday, at which, in addition to the members of the Government | |||||
| who were to be present, the Canadian Premier, Sir John Thompson, was to attend in order | |||||
| to receive the distinguished honour of being sworn in as a Privy Councillor. | |||||
| 'Sir John was duly invested with the honour destined for him, but, while lunching with | |||||
| other Ministers after the ceremony, apparently in the best of health, he was seized with a | |||||
| fainting fit, and, after apparently recovering, suddenly expired. | |||||
| 'The Marquis of Breadalbane, who, as Her Majesty's Lord Steward, attended the Council | |||||
| meeting yesterday, has given the following account of the sad occurrence to the Press - | |||||
| "I saw Sir John on the platform at Paddington, and travelled to Windsor in the same saloon | |||||
| with him. He appeared all right then, and afterwards at the meeting. After being duly | |||||
| sworn as a member of the Privy Council he retired to the luncheon room, and while we | |||||
| were sitting there he suddenly fainted. One of the servants and I each took an arm, and | |||||
| we got him into the next room and placed him beside the windows. I got some water for | |||||
| him and sent a servant for a little brandy, and in a short time he revived somewhat, and | |||||
| seemed much distressed at having made what he regarded as a scene, remarking, "It | |||||
| seems too weak and foolish to faint like this." I replied, "One does not faint on purpose. | |||||
| Pray don't distress yourself about the matter." He then begged me to return to my | |||||
| luncheon, but of course I would not hear of this, and remained with him till he seemed to | |||||
| have completely recovered, and rose to accompany me back to the luncheon room. I | |||||
| offered him my arm, but he walked unaided, cheerfully remarking, "I'm all right now, thank | |||||
| you." In the meantime Dr. Reid, the Queen's physician, whom I sent for, had arrived. | |||||
| Within two or three minutes of Sir John's return to the luncheon room, and I believe | |||||
| before he had tasted the cutlet or whatever had been placed before him, I saw him | |||||
| suddenly lurch over and fall almost into Dr. Reid's arms. At the doctor's request the ladies | |||||
| at table all went out, and the doctor and I and some servants alone remained. We did all | |||||
| that was possible, but I felt his pulse and was confident that no aid could prevail. The | |||||
| doctor held the same view, and it unhappily proved to be but too correct. So far as I | |||||
| could see Sir John had been in good health up to the time of his first seizure, but I | |||||
| believe he told Dr. Reid he had pains in the chest. The cause of death was undoubtedly | |||||
| a sudden failure of the heart's action." | |||||
| 'Last night's Court Circular stated "that, to the Queen's very great regret, the Hon. Sir | |||||
| John Thompson, K.C.M.G., Q.C., Premier and Minister of Justice in Canada, who had just | |||||
| been sworn in a member of Her Majesty's Privy Council, died suddenly of syncope a few | |||||
| minutes after leaving the Council-room. Sir John mentioned that he was suffering from | |||||
| a heart affection for which he had been undergoing medical treatment, and was feeling | |||||
| unwell at the Castle. Dr. Reid was present at the moment of the seizure, and rendered | |||||
| every possible assistance." | |||||
| The attempt in 1915 to remove Privy Counsellors of foreign birth | |||||
| In 1915, during the Great War, Sir George Makgill, 11th baronet and Secretary of the Anti- | |||||
| German Union, attempted to have two foreign-born members of the Privy Council removed. | |||||
| The two members concerned were Sir Ernest Joseph Cassel and Sir Edgar Speyer. | |||||
| The following report on the subsequent hearing of this matter appeared in 'The | |||||
| Manchester Guardian' of 18 December 1915:- | |||||
| 'The attempt to deprive Sir Ernest Cassel and Sir Edgar Speyer of their membership of | |||||
| the Privy Council has failed. A King's Bench Divisional Court, consisting of the Lord Chief | |||||
| Justice [Lord Reading], and Justices Avory and Lush, yesterday delivered a reserved | |||||
| judgment against the relator, Sir George Makgill, at whose instance the question was | |||||
| raised. | |||||
| 'The matter last came before the Court on November 18, when the hearing was concluded | |||||
| of the arguments on the rules, obtained on June 23 last at the instance of Sir George | |||||
| Makgill, directing them to show cause why an information in the nature of a quo warranto | |||||
| [Latin for "What warrant?" - it is a writ requiring the person at whom it is directed to show | |||||
| what authority they have for exercising some right or power they claim to hold] should | |||||
| not be exhibited against them to show by what authority they were, or claimed to be, | |||||
| members of the Privy Council. | |||||
| 'The ground of the rules was that Sir Ernest Cassel and Sir Edgar Speyer were born out of | |||||
| the United Kingdom and the Dominions, and were not born of English parents, and that, by | |||||
| the Act of Settlement, and the British Nationality and Status of Aliens Act 1914, they | |||||
| were not capable to be members of the Privy Council. | |||||
| 'The Lord Chief Justice, giving judgment, said Sir Edgar Speyer had not filed any evidence, | |||||
| on the ground that, having resigned, he could not claim a distinction which he had applied | |||||
| to give up [see the note under Sir Edgar Speyer in the baronetage pages], even though | |||||
| his Majesty had been pleased to refuse to accept that resignation. He had, however, sent | |||||
| counsel to assist the Court. Sir Ernest Cassel had appeared, through counsel, to maintain | |||||
| his right. The matter complained of was that both of these gentlemen had been illegally | |||||
| and wrongfully sworn as members of the Privy Council, because this was contrary to the | |||||
| Act of Settlement. | |||||
| 'The Attorney General had, however, intervened, and placed a preliminary objection that | |||||
| it was not possible for the writ of quo warranto to lie for the following reasons:- | |||||
| 1. That it could only be applied when there had been a usurpation of office, and action | |||||
| was taken by the Crown. | |||||
| 2. No judgment favourable to the relator [Makgill] was enforceable, because it involved | |||||
| an order of the Crown. | |||||
| 3. Because the position of Privy Councillor was not an office. | |||||
| 4. That in any event, whatever was the right description of the total liabilities and | |||||
| privileges which were involved in membership of the Privy Council, it was an office that | |||||
| was held at pleasure. | |||||
| 5. That it was not a matter of Crown Office information, or private action, but only for | |||||
| information by the Attorney General. | |||||
| 'As to the first point, the Attorney General had argued that originally the writ of quo | |||||
| warranto was only available for the King's use for the purpose of protecting himself | |||||
| against the usurpation of the Royal prerogative, and the writ was still equally limited in | |||||
| its availability as a remedy. His Lordship was of opinion that the point failed. With regard | |||||
| to the second point, that proceeded on the assumption that, if the Court could grant an | |||||
| "ouster" in the present case, they would be making an order upon the Sovereign. If that | |||||
| were the proper view to take upon the subject it would succeed, because the Court was | |||||
| not able to make an order on the Sovereign. When there was a duty to be performed by | |||||
| the Crown, the Court had no power to issue commands on the Crown. A judgment against | |||||
| the respondents would have effect against them only. It would be an order on the | |||||
| subject, and not upon the Crown. | |||||
| 'It was also contended that the Court would be powerless to order the Registrar to the | |||||
| Privy Council to remove the names; neither could it prevent him from re-entering the | |||||
| names, because they had been put there by the order of his Majesty. It was quite | |||||
| enough to say that a judgment pronounced in favour of the relator would not involve an | |||||
| order upon the Registrar. This was the King's Court, and they sat to dispense justice and | |||||
| interpret the law of the realm in the name of the King, and is was respectful to assume | |||||
| that, once the law of the land had been pronounced, it would be followed by the Crown. | |||||
| 'As to whether the third point was successful depended on whether the membership of | |||||
| the Privy Council constituted an office, and whether it was a public office or otherwise. | |||||
| "Office" was not used in the strict sense, but, in his opinion, the membership of the Privy | |||||
| Council was an office. With it was imposed obligations of State, and the office could not | |||||
| be held if the Court pronounced an ouster. | |||||
| 'The fourth point, he thought, was immaterial, and the final point failed. The present | |||||
| application concerned a public matter, and there was no reason for impugning the motive | |||||
| of the relator. The matter appeared to have been brought to the Court by Sir George | |||||
| Makgill purely on public grounds. Therefore, the Court thought that the writ could lie, and | |||||
| the preliminary objection failed. | |||||
| 'With regard to the main issue, continued his Lordship - viz., whether the appointment of | |||||
| the respondents was contrary to law, having regard to the Act of Settlement and the | |||||
| Consolidation Act 1914, - he said the Act of 1870 extended to naturalised subjects | |||||
| certain privileges, and, the respondents having been naturalised subsequent to 1870, they | |||||
| were in such a position as enabled them to be appointed Privy Councillors. Mr. Powell, KC, | |||||
| who had appeared for the relator, argued with great force that since the Act of 1914 the | |||||
| respondents had ceased to be members of the Privy Council, because the Act re-enacted | |||||
| the Act of Settlement, but with that submission the Court did not agree. The Court was | |||||
| of opinion that the effect of the statutes was to give the naturalised subject all the | |||||
| privileges of a British-born subject. Under these circumstances, the contention of the | |||||
| relator failed. The orders must, therefore be discharged, as to Sir Edgar Speyer without | |||||
| costs, and as to Sir Ernest Cassel with costs.' | |||||
| Sir Ernest Cassel continued to be a member of the Privy Council until his death in 1921. | |||||
| Sir Edgar Speyer's name was, however, struck off the list of members in December 1921 | |||||
| [for further information see the note under his baronetcy]. | |||||
